Refund & Cancellation Policy

This Refund Policy applies to all services purchased from ALEXANDRU STEFAN TOIA, Laurentiusstraße 34, 74676 Niedernhall, Germany. It supplements our General Terms and Conditions (AGB) and complies with the German Civil Code (BGB) and EU consumer protection law.

1. Right of Withdrawal for Consumers (Widerrufsrecht)

If you are a consumer within the meaning of §13 BGB and conclude a distance contract with us, you have the right to withdraw from this contract within 14 days without giving any reason, in accordance with §§355, 312g BGB. The withdrawal period expires 14 days after the day of contract conclusion. To exercise the right of withdrawal, you must inform us by a clear declaration (e.g. an email to info@toiaboost.de) of your decision to withdraw.

2. Effects of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and not later than 14 days from the day on which we are informed of your decision. We will use the same means of payment used for the initial transaction unless expressly agreed otherwise.

3. Premature Expiry of the Right of Withdrawal

The right of withdrawal expires prematurely if the service has been fully performed and performance began only after the consumer gave express consent and confirmed knowledge that the right of withdrawal would lapse upon full performance (§356(4) BGB). If services begin during the withdrawal period at your request, you owe pro-rata compensation for services rendered up to the point of withdrawal.

4. Business Clients (B2B)

The statutory right of withdrawal applies only to consumers and does not apply to business clients (Unternehmer, §14 BGB). For B2B engagements, monthly retainers are non-refundable once the billing cycle has begun because resources are reserved and execution has commenced on your behalf.

5. Goodwill Guarantee

Notwithstanding the above, if within 14 days of your first invoice you are not satisfied with onboarding and choose to discontinue, we will, as a goodwill gesture, refund any unused portion of your first month's fee, less verifiable third-party costs already paid out (e.g. ad spend, software licences, talent fees).

6. Third-Party Costs and Ad Spend

Budgets paid directly to advertising platforms (Meta, Google, TikTok, LinkedIn) are non-refundable by us. Refund requests relating to ad spend must be addressed to the respective platform.

7. Cancellation of Ongoing Plans

Monthly plans may be cancelled with 30 days' written notice (email is sufficient) to the end of a calendar month. Services continue — and are billable — during the notice period.

8. How to Request a Refund

Send an email to info@toiaboost.de with your invoice number, the service concerned and the reason for the request. Eligible refunds are processed within 14 days to the original payment method.

9. Disputes

Any disputes shall be handled in accordance with our Terms & Conditions. The European Commission's ODR platform is available at ec.europa.eu/consumers/odr.
